章节摘录

Corrections and alterations on an original bill of lading must be authenticated. Such au- thentication must appear to have been made by the carrier, master (captain) or any of their a- gents (who may be different from the agent that may have issued or signed it), provided they are identified as an agent of the carrier or the master (captain). In shipping practice, different shipping companies may issue varied-formatted bill of lading, with detailed contents that depend on the modes of marine transportation, based on the shipper s letter of instructions. A sea freight shipper s letter of instruction specimen and two B/L specimens are given in the Appendix part of this Chapter. Among the latter, one is in filled form, another one is in blank form. 5.2.5 Usual Customs and Practices Laws and usual customs and practices governing bill of lading may be discussed from two aspects. One aspect is related to the rights, responsibilities, and liabilities of the carrier and the shipper under a B/L, which is not the focus of this chapter. The other aspect is related to the standards of preparing and examining a B/L under an L/C, which is the focus of this chapter to be discussed in great details. (1) Usual customs related to the rights, Responsibilities, and Liabilities of the Cartier and the Shipper under a B/L. The rights, responsibilities, and liabilities of the carrier and the shipper under a B/L are governed generally either by the older Hague rules, by the more recent Hague-Visby rules, or by the latest Hamburg rules.
